END USER LICENSE AGREEMENT (EULA)

CrewChief Web‑Based Services
Effective Date: 1/27/2026

This End User License Agreement (“Agreement”) is a legally binding contract between you (“User” or “You”) and Iler Group, Inc., the owner and developer of the CrewChief web‑based service (“Service”), accessible at www.crewchief.biz. By accessing or using the Service, You acknowledge that You have read, understood, and agree to be bound by the terms of this Agreement.

1. License Grant

1.1 License. Subject to Your compliance with this Agreement, Iler Group, Inc. grants You a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for personal or commercial purposes through a compatible web browser.

1.2 Data Use Limitations.
a. Data may only be used in a normal, human‑driven manner. Use of automation, artificial intelligence, or tools designed to artificially increase data visibility, transactions, or usage beyond typical human interaction is prohibited.
b. CrewChief reserves the right to reduce, suspend, or terminate data usage at any time, at its sole discretion.

1.3 Notification Limits.
Each paid asset includes a monthly allocation of 50 SMS notifications and 100 voice notifications. CrewChief may adjust, restrict, or terminate notification capabilities at its discretion.

2. Data Collection and Privacy

2.1 Types of Data Collected. The Service may collect the following types of data:
a. Location Data: Real‑time IP‑based or user‑provided location information.
b. Device Information: Browser type, operating system, and unique device identifiers.
c. User‑Generated Content: Alerts, status updates, and voluntary reports submitted by You.
d. Usage Data: Page views, feature usage, and error logs.

2.2 Purpose of Data Use. Data is collected and processed to:
a. Facilitate a priority event response and coordination.
b. Alert nearby users or organizations of priority events.
c. Provide real‑time situational awareness.
d. Improve Service performance and user experience.

2.3 Data Sharing.
Data may be shared with authorized public safety agencies and nearby users during active priority events as configured by You. Personal data is not sold to third parties.

2.4 User Control and Consent.
a. You may manage data‑sharing by not using the service.
b. You may request deletion or correction of personal data by contacting support. Requests may be subject to a service fee.
c. You may withdraw consent at any time, subject to legal obligations.

2.5 Data Security.
Industry‑standard security measures are implemented to protect Your data from unauthorized access and misuse.

2.6 Data Retention.
a. Data is retained only as long as necessary to fulfill the purposes outlined or as required by law. Inactive accounts may be purged after a defined period.
b. Media is retained for a minimum of 370 days. It may be purged at any time thereafter without additional notice.
c. Excessive storage volume as determined by Iler Group, may result in additional monthly fees.

2.7 Legal Compliance.
The Service complies with applicable laws, including the California Consumer Privacy Act (CCPA).

3. User Responsibilities

3.1 You agree to use the Service lawfully and in compliance with this Agreement.

3.2 You agree not to submit false reports, interfere with emergency services, or misuse the Service in any way.

3.3 You are responsible for maintaining the confidentiality of Your login credentials.

3.4 This is a self-monitored service. You are responsible for monitoring and responding to all notifications and events.

4. Intellectual Property

All content, features, and functionality of the Service are the exclusive property of Iler Group, Inc., protected by applicable intellectual property laws. You receive no rights beyond those expressly granted in this Agreement.

5. Termination

Iler Group, Inc. may terminate this Agreement and Your access to the Service at any time without prior notice and a refund of unused service fees. Upon termination, You must immediately cease all use of the Service.

6. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. Iler Group, Inc. does not guarantee the accuracy, availability, or reliability of any data or features of the Service.

7. Limitation of Liability

To the fullest extent permitted by law:

7.1 Iler Group, Inc. shall not be liable for indirect, incidental, special, or consequential damages.

7.2 Iler Group, Inc. shall not be liable for loss of profits, data, or goodwill.

7.3 Iler Group, Inc. shall not be liable for unauthorized access to or use of Your data.

7.4 Total liability is limited to the amount paid by You (if any) during the six (6) months preceding the claim.

7.5 All claims must be filed within six (6) months of the event giving rise to the claim.

8. Governing Law; Dispute Resolution; Legal Fees

8.1 This Agreement is governed by the laws of the State of Florida.

8.2 All disputes shall be resolved through binding arbitration in Hillsborough County, Florida, pursuant to the Florida Revised Arbitration Act.

8.3 Each party shall bear its own legal fees, when allowed by law.

8.4 Injunctive or equitable relief may be sought in court if necessary.

9. Changes to this Agreement

Iler Group, Inc. may modify or update this Agreement at any time. Continued use of the Service following such changes constitutes Your acceptance of the revised Agreement.

11. Hold Harmless and Waiver of Liability

11.1 By using the Service, You assume all risks associated with receiving assistance.
11.2 You agree to hold harmless Iler Group, Inc. and its affiliates from any claims or damages arising from:
a. Use or misuse of the Service.
b. Assistance rendered or not rendered.
c. Any resulting injury, loss, or damage.
d. Delays in notifications
e. Late or no response by government emergency services since the service is not monitored by said agencies.

12. User Ban and Content Removal

Iler Group, Inc. may ban users, restrict access, or remove content at its sole discretion and without liability.

13. Errors and Omissions

The Service may contain typographical errors, inaccuracies, or omissions, including in content, data, or technical information. Iler Group, Inc. does not warrant that such issues will be corrected. You acknowledge that You are responsible for verifying any information before relying on it, and Iler Group, Inc. is not liable for damages arising from reliance on such information.
